legislation reflects the growing return of temporary placements. in particular, rental legislation in the uk, spain, and germany has been put in place to increase rental stability. the uk announcement followed a situation when “golden handcuffs” made it practically impossible for landlords to re-let a property and therefore make a profit from the buy to let activity. in berlin, factors such as the increase in number of holiday flats available and a shortage of vacant homes, meant that the rental market faced an affordability problem and following a surge in demand for furnished holiday accommodation, the berlin rental platform (rentalmeters) was opened in 2016. berlin had the highest number of properties that remained vacant. according to the german federal ministry for economic affairs and energy, there are currently around 2 million households with a vacancy gap and a shortage of more than 115,000 dwellings. the 2012 local housing law came into force in march 2016 and applies to all landlords with over 10 rental units. the intention of the law was to reduce the vacancy gap and to force owners to remove exploitative rental contracts from tenants. the new law also increased the number of units that can be rented out below the usual asking rent of €7.65 per square metre per month. it is hoped that this will reduce the fact that wealthy property owners lease out cheap flats, leaving those that can’t afford the rent on the streets. the new law allows for a maximum of three years of “golden handcuffs”, making it more difficult to terminate a tenancy. the legislation also requires that a property owner notify the ministry of finance and any tenants at least four months prior to terminating a tenancy. once a property owner sends this notice, any costs incurred by the property owner in relation to a rental tenancy will be reimbursed by the state. in january 2016, new legislation came into effect in spain. the new law stipulates that a property owner must serve a two-month notice to a tenant to terminate the rental agreement, and that “the notice is not to be confused with the rent.. (but) it is an economically effective instrument for the termination of the agreement.” the new law also aims to better protect the rights of tenants. a tenant must be given at least 30 days’ notice of a decision to end a rental agreement. this measure also increases the minimum notice period for terminating a rental agreement, from one month to two months. in germany, a new law that took effect in april 2016 calls for landlords to provide landlords with 45 days’ notice for terminating a tenancy and for the appointment of a new tenant to be completed within the same 45-day period. in april 2016, portugal passed the “portugal for all” renting act. it aims to give all portuguese citizens the right to permanent housing. the act went into effect on the 1st of may 2016, giving portuguese citizens the same right of permanent housing as in spain, the united kingdom, france, and many other countries. this is also expected to benefit non-eu citizens, many of whom were not granted automatic right to rent in portugal.
