In its deferred prosecution agreement, Airbus agreed to pay a criminal fine of $34.8 million to the U.S. government; perform one year of working with the United States as a designated foreign corporation pursuant to the Foreign Corrupt Practices Act; and avoid future FCPA violations. The U.S. Attorney’s Office declined to comment on the size of the corporate fine. However, in a Dec. 16, 2019, press release, the U.S. Attorney’s Office announced the deferred prosecution of Airbus, adding that the total settlement includes a corporate fine paid to the U.S. government. The release did not specify the amount of the fine
As part of the resolution, Airbus has completed remedial measures related to its stated business practices and the U.S. government has concluded that the global aerospace group has taken those measures. As the U.S. Attorney’s Office stated in the release, this resolution to the case achieves maximum deterrence against Airbus and others contemplating similar conduct in China and elsewhere. Cooperation with HSI is critical to investigators addressing these and related corruption-related issues, including addressing corruption that may be impacting government contracting and national security.
